Terms and Conditions for Private Customers (B2C)

Preamble
- Plagge.IT - Software Development (hereinafter acalled „the supplier“) operates an online store at www.mi-camino.com where private customers (consumers according to para. 13 German Civil Code/BGB) can acquire personalized t-shirts as souvenirs of their pilgrimage.
01. Ordering Process
- The customer can select, customize and order products in the supplier's online store. Every product has its own page containing the pertinent product information. When a customer selects a product, he can start designing it by using the unique timeframe of his or her journey. By clicking „next“, the customer reaches the next step, clicking „back“ leads him or her to the step before. At the end of the configuration process, the customer can place his product into the shopping cart by clicking „add to cart“. This action is non-binding. The contents of the shopping cart can be viewed by clicking „shopping cart“, or removed from the cart by clicking „delete article X“ at any time. If the customer wishes to buy the products in the shopping cart, all he or she has to do is click „checkout“, and then enter the necessary data (name, address, payment method etc.). Obligatory information are marked „*“. Ordering does not necessitate registration. After entering the data and selecting payment and shipping options, the customer clicks „order summary“ which leads him or her to an order summary page where the customer can review the order. Clicking „Order“ concludes the ordering process, by submitting a legally binding offer to conclude a contract on the part of the customer. A text pertaining to this legally binding agreement is displayed after the ordering process is concluded. The process can be aborted at any time before this, by clicking „back to ordering details“ or by closing the browser tab. Each page during ordering process supplies more information, i.e. on how to correct information etc.
02. Contract Conclusion
- The tenders in the supplier's online store are subject to change. A contract is only concluded by an express declaration of acceptance on the part of the supplier or implied by sending the ordered goods to the customer. When selecting advance payment, the contract is concluded with shipment of the order or the contract confirmation email sent upon receiving the order.
03. Contract Execution
- The supplier can accept the customer's contract offer (order) within two (2) days. Unless the individual product pages state otherwise, the products are immediately available. Information on shipping options and costs can be found on the „shipping information“ page. The supplier accepts the following payment methods: Paypal and advance payment.
04. Contract Text
- The contract will be stored in the supplier's internal system. The terms and conditions can be viewed at any time by clicking the menu item "Terms & Conditions". Both order information and the terms and conditions will be sent to the customer via e-mail. After completing the purchase, the contract is no longer accessible online for security reasons.
05. Prices
- The prices specified in the online shop at the time of the order apply. The prices are final prices incl. VAT and excl. shipping costs. The shipping costs are specified on the pertinent pages.

You may withdraw your contract declaration in writing (i.e. letter, email) within 14 days using our withdrawal template (download here). The withdrawal deadline begins after receipt of this notification in writing, but not before receipt of the goods (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and not before fulfilling our obligations to inform under art. 246 para. 2 in connection with para. 1 sec. 1 and 2 EGBGB (Introductory Law to the German Civil Code) and our obligations according to para. 312e sec. 1 sentence 1 BGB (German Civil Code) in connection with article 246 para. 3 EGBGB (Introductory Law to the German Civil Code). The withdrawal period is kept by sending the withdrawal declaration. The right to withdrawal expires 1 year from the expiry of the 14-day period. A withdrawal must be sent to:

Consequences of Withdrawal
Where withdrawal applies and comes into action, the mutually received goods are returned and any accrued benefits (e.g. interest) are paid out. If you cannot or can only partially or in deteriorated condition return the goods you received from the supplier, you are obligated to compensate for the lost value. When it comes to the deterioration of the product, you only have to compensate to the extent that the deterioration is due to use beyond examining the product. „Examination“ is defined as testing and trying out the goods, as is possible and common in brick-and-mortar stores.
Shippable items are to be returned at our risk. You have to bear the shipping cost. Non-shippable orders will be collected at your place.
Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you upon sending your contract withdrawal or returning the goods, for us with their reception.

Exceptions
The right of withdrawl does not a apply,
- where the customer is a business according to para. 14 of the German Civil Code (BGB) and acted as a business (company or self-employed) in the conclusion of the contract;
- for distance contracts for the supply of goods which are manufactured according to customer specifications,
- for distance contracts for the supply of goods, which are clearly tailored to personal needs.
07. Costs agreement in case of withdrawal
- If the customer makes use of his right of withdrawal, he or she is required to bear the cost of return shipping.
08. Warranty and Liability
- The general warranty regulations apply.
09. Retention of Ownership
- Until full payment is made, the goods remain the property of the supplier.
10. Final Provisions
- The contract language is German, the contractual relationship between the parties are governed by German law, excluding the UN Sales Convention.
